Terms and conditions governing the use of our analytics platform

These Terms of Service ("Terms") govern your access to and use of the FusionTrixum beauty product demand analytics platform and related services provided by FusionTrixum S.A., a company registered in Portugal with registration number 613528714 and registered office at Rua de São Bento 5, 4088-814 Porto, Portugal.
By accessing or using our platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our services. These Terms constitute a legally binding agreement between you and FusionTrixum S.A.
You must be at least 18 years old and have the legal capacity to enter into contracts to use our services. By using our platform, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.
FusionTrixum provides a cloud-based analytics platform specialising in beauty product demand forecasting and market intelligence. Our services include data analysis, reporting tools, market insights, and related analytics functionality designed for beauty industry businesses.
We strive to maintain high service availability but do not guarantee uninterrupted access. Scheduled maintenance, updates, and unforeseen technical issues may temporarily affect service availability.

You may not use our platform for any illegal activities, to violate intellectual property rights, to transmit harmful content, or to interfere with the platform's operation or other users' access.
The FusionTrixum platform, including all software, algorithms, designs, text, graphics, and other content, is owned by FusionTrixum S.A. and protected by intellectual property laws. We retain all rights, title, and interest in our platform and proprietary technology.
You retain ownership of the business data you upload to our platform. By using our services, you grant us a licence to process, analyse, and use your data solely for the purpose of providing our analytics services to you.
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable licence to access and use our platform for your business purposes during your subscription period.
Our services are provided on a subscription basis with fees as specified in your service agreement or as displayed on our platform. Payment terms, billing cycles, and refund policies are outlined in your subscription agreement.
We may modify our pricing with reasonable notice. Price changes will not affect your current billing cycle but will apply to subsequent renewal periods.
We implement appropriate technical and organisational measures to protect your data. Our data processing practices are governed by our Privacy Policy, which forms part of these Terms. You are responsible for maintaining appropriate security measures for your account access.
To the maximum extent permitted by law, FusionTrixum S.A. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our platform.
Our total liability for any claims arising from or relating to these Terms or our services shall not exceed the amount paid by you for our services in the twelve months preceding the claim.
Our platform is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that our analytics predictions will be accurate or that our services will meet your specific requirements.
You agree to indemnify and hold harmless FusionTrixum S.A. from any claims, damages, losses, or expenses arising from your use of our platform, violation of these Terms, or infringement of third-party rights.
These Terms are governed by and construed in accordance with the laws of Portugal. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Porto, Portugal.
If you are a consumer resident in the European Union, you may have additional rights under applicable EU consumer protection laws, which these Terms do not seek to exclude or limit.
Either party may terminate the service agreement with appropriate notice as specified in your subscription terms. We may immediately suspend or terminate your access if you breach these Terms or engage in prohibited activities.
Upon termination, your access to the platform will cease, and we may delete your account and data in accordance with our data retention policies. Provisions regarding intellectual property, limitation of liability, and governing law shall survive termination.
We may modify these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will provide reasonable notice of material changes, and continued use of our platform after such changes constitutes acceptance of the modified Terms.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.
